    Ok, here’s a question for anyone who may know the answer… let’s say a person is reported in this form to have been arrested and jailed on DUI. What’s the chances that there is an error in the report and the person was actually just ticketed for speeding?

    Also… if he were actually jailed, to be reported in this log…is there a chance that a person was actually booked and charged in error, in some sort of mixup with whatever test was administered…..to where the charge was later reduced to speeding???

    Hypothetically wondering, of course :)

    If the person appears in the “jail log” they were in fact taken to the St. Johns County jail and processed … fingerprinted, photographed, the whole nine yards.

    Do mix-ups occur? Of course. Do charges get dropped, overturned in court, or, reduced? You bet.

    I have spoken to the Sheriff on any number of occasions about this, even when he was still Chief of Police. David is not a fan of publishing the “jail log” and he has joked that it is only good for feeding the local gossips.

    I assume that HCM has decided that the information does serve some useful purpose. It is public information. I suppose it might help someone discover that the reason their friend, relative or employee didn’t show up wherever they were supposed to be is because they are cooling their heels in jail.

    Although The Record version does not, the version posted here does provide the booking number so that you can quickly look up the bond information on the SJSO website.

    Interesting info, Mike. I have to wonder how likely a DUI incarceration would be to turn into a speeding ticket. Judging by the recent events with several other notables around town… I would have guessed ‘not very likely’.

    Oh well… easy enough to check into, if it matters, I suppose. So how do you get the booking numbers from an older version of The Record’s?

    As Mike pointed out the jail log indicates what charges are brought to justify booking the individual in jail, i.e., citing what law/statute was allegedly broken.

    In the case of DUIs the accused may have been through a performance test, may have blown or refused to blow, and may signed or refused to sign the acknowledgement of receiving the traffic ticket - or any combination of those.

    The only thing absolutely certain (barring human errors) from the jail log is with what offense the jailed person is charged.

    Many persons charged and jailed with DUIs are never convicted of DUI, just as many persons charged and jailed with aggravated assault are never convicted of that charge.

    That is one major reason why many, including Shoar, don’t like to see the jail log published, as “innocent until proved guilty” is overlooked by the average reader - and if a charge is later reduced or dropped by the States Attorney, many immediately conclude there has been something sneaky, unethical or illegal done.

    I figured the same as you describe, but isn’t refusal to take a physical test grounds for conviction in our state/county. If not, what exactly are the circumstances if one refuses, ultimately.

    And could there ever be a case of a plea sort of arrangement in DUI’s…without suffering the wrath of MADD and other organisations?

    Refusing to cooperate in testing in many jurisdictions, including Florida the last time I checked, results in the suspension/revocation of one’s Driver’s License - REGARDLESS of whether one is ultimately convicted of DUI.

    In other words you can win the battle (avoid a DUI conviction) but lose the war (lose your license to drive for a period)!

    Many people “beat” DUI charges (I know a prominent St. Augustinian who has been jailed for DUIs seven times in Florida, but convicted only once), regardless of MADD’s influences, and there are a number of Florida attorneys who specialize in DUI cases.

    Since jail logs are public, those jailed on DUI charges shortly receive letters from DUI attorneys - sort of like the infamous “ambulance chasers” or yore.
