Friday night St Augustine police were called to Kilwin’s on St George Street, when witnesses reported that a 16-year-old boy had been struck in the face and knocked to the floor inside the chocolate, fudge and ice cream shop, according to information obtained by Historic City News today.
Once on the scene, police found a store patron assisting the teenage victim until emergency medical personnel arrived. The witness told police that two young men, in their early 20’s, had been outside the store and appeared to be talking to the victim before the altercation occurred.
According to the incident report, one of the men, identified as 18-year-old Michael Austin Wooleyhan, followed the victim into Kilwin’s and attempted to start a fight; however, the younger teen refused.
“Then get on your knees and tell me you’re my bitch,” Wooleyhan demanded, when the juvenile would not fight with him. When the victim again refused, Wooleyhan took a swing at him — striking him on the nose with his closed fist.
The 16-year-old victim was transported to Flagler Hospital in St Augustine, where he was treated. Police notified the boy’s mother, who informed officers that she would meet her son at the hospital when she got off work. Police officers obtained photographs of the boy’s injuries.
The Emergency Department physician told officers that the patient suffered a fracture, described as small, on the left side of his nose. During the altercation, it appears that the victim also sustained a chipped front tooth, the doctor said.
On Saturday, the victim and his mother went to the Police Station to identify the person who the victim says attacked him. The victim said that after he was released from the hospital, he went home and found his attacker’s profile on facebook. He identified 5’10”, 136 lb., Michael Austin Wooleyhan in a sworn affidavit. The matter has been turned over to the State Attorney for the Seventh Judicial Circuit to determine if felony battery charges will be filed against Wooleyhan.
