This morning, Historic City News received copies of documents filed on Monday, September 14th, by Jacksonville defense attorney Bill Sheppard, in the United States District Court for the Middle District of Florida, Jacksonville Division; dismissing the claim of malicious prosecution by Jeremy Banks against Rusty Ray Rodgers.
The counter-claim to a suit instigated by deputy Banks, was filed after Sheppard’s client, Florida Department of Law Enforcement Agent, Rusty Ray Rodgers, was cleared of any criminal wrongdoing in his investigation of the deputy, who Rodgers considers a “prime suspect” in the death of his former girlfriend, Michelle O’Connell.
The dismissal was filed “without prejudice” which leaves the door open to further action in the matter at some point in the future. There was no indication of a financial settlement between the parties, as that would typically be dismissed “with prejudice”.
The local law office of R. L. “Mac” McLeod is representing Banks and was copied on the notice of dismissal.
