After being found guilty on December 11 of all four-counts of lewd or lascivious sexual battery against a child, James Howard Scharfschwerdt will appear in court for sentencing on Tuesday February 5th — but this case is not over yet.
Scharfschwerdt was convicted of (4) separate instances of molesting young boys, between the ages of 12 and 16 years-old, that he lured with fishing and boating activities.
The evidence in the trial showed that Scharfschwerdt used alcohol and child pornography to coerce his victims to perform sexual acts. Each charge is a second-degree felony.
When the 56-year-old former South Florida police officer appears before Judge Terrill J Larue in courtroom 264 at 9:00 a.m., Scharfschwerdt intends to file a motion with the court for a new trial.
Public Affairs Director Klare Ly, with the Office of State Attorney R.J. Larizza, told Historic City News that Scharfschwerdt faces up to 45-years in prison.
