Letter: Zoning Conundrum

North Davis Shores residents have been resilient in their efforts to call attention to the numerous zoning issues throughout the city; and in particular the property known as the “castle” at 100 Flagler Boulevard. Current zoning does not align with current and historical property usage of this and many other properties.
It is no longer compliant with the overall Comprehensive Plan for the city, nor does it fit the vision for the city moving forward.
The City is caught in a Catch 22 situation. Although they can administratively rezone 100 Flagler and various other properties, it would leave them open to litigation by the property owners under the Bert Harris Act, which could potentially cost the city a hefty sum of money.
Then, the Commissioners have to weigh if the cost is worth saving the appeal and cohesiveness of the city as a whole. If the properties are not rezoned, past mistakes will create future nightmares.
The best case scenario would be for property owners themselves to want the best for the city as a whole and the community where they reside; and voluntarily agree to rezone. It is an opportunity for them to do what is good for the whole and be a part of the solution.
Proper zoning is essential in maintaining a balance between commercial and residential development. Zoning is critical to the overall livability of our neighborhoods.
Due to the efforts of the North Davis Shores residents and those of others, the City Commissioners are listening. On Monday the issue of the “Castle” in North Davis Shores and the overall issue of zoning will be discussed at the City Commission Meeting.
