The 21-year-old Palm Coast man who attempted to use a samurai sword to destroy a computer and compact disks containing thousands of images of child pornography when confronted by FBI agents, pled guilty today to a federal charge of receiving child pornography over the Internet.
Under the plea agreement, Kamil Mezalka faces a mandatory minimum sentence of 5 to 20 years in federal prison, a $250,000 fine, and a potential life term of supervised release; as well as forfeiting his computers and other digital media, according to US Attorney Robert E O’Neill.
On March 15, 2012, an agent with the Federal Bureau of Investigation in Philadelphia used a computer in his office to observe that over 4,000 files, many of which contained titles and descriptions of child pornography and the sexual abuse of children, were being downloaded to an IP address issued to an account registered to an individual at Mezalka’s residence in Palm Coast.
A federal search warrant was served on May 8, 2012; however, when Mezalka spotted the agents, he closed himself in his second floor bedroom and attempted to destroy his computers and disks with the sword. The agents seized, among other things, a damaged desktop computer and a damaged laptop computer.
Forensic analysis revealed that one of the hard drives contained over 12,000 images and over 3,000 videos; of which, at least 500 images and 100 videos depicted child pornography.
During an interview, Mezalka admitted, among other things, to having a file sharing program on his computer which he used to download pornography, to include child pornography.
His sentencing date has not yet been set.
