The complaint was filed by a Jacksonville law firm representing Jeffrey Marcus Gray; who alleges, in part, that on one or more occasions Ricky C. Domingo, Bryan Keith Harrington, Richard Pittman, and David Ramos used their law enforcement access to his confidential driver information contained in Florida’s computerized Drivers and Vehicles Information Database, for a non-law enforcement purpose in violation of the Act.
The database, known by the acronym “DAVID”, is a computerized central information file containing driver and motor vehicle information as well as a gallery of driver’s license photographs that span the life of the driver. Records in the database include protected personal information, such as social security number, date and state of birth, emergency contact information, and certain medical information. Reports obtained from DAVID include a compilation of civil and criminal citations against the driver, with dispositions, as well as registration details for all current and former motor vehicles belonging to the driver.
In Florida, the database is maintained by the Florida Department of Highway Safety and Motor Vehicles and law enforcement access is controlled by the Florida Department of Law Enforcement.
The complaint, which also names the Sheriff’s Office as a defendant, alleges that the individual deputies violated the Act; on two occasions by Domingo, Harrington on one occasion, Pittman on two occasions, and Ramos on five occasions, knowingly obtained or disclosed Gray’s personal information from the DAVID system for an unauthorized and illegal purpose.
Gray, through his trial counsel, Andrew M. Bonderud, Esq., of the Bonderud Law Firm, P.A., located at 301 West Bay Street, #1433, in Jacksonville, has demanded a trial by jury on all issues so triable.
