Local St. Augustine reporters at Historic City News have learned that last night the actions of a 32 year-old homeless man in downtown St. Augustine could have caused him to be shot by police, however, he was taken into custody without injury.
Corporal Kevin Schmoll and Officer Bryan Johnson responded to the east plaza area near the market building after receiving a report that a man was upset that he was asked to leave the American Legion Bar on Anderson Circle.
Police found Todd Joseph Johnston threatening to “Make them pay because no one tells me what to do.”
Schmoll observed Johnston reach for his waist band with his right hand, twice.
When ordered to show officers his hands, Johnston yelled, “ I’ll kill you” and ran towards the officers.
After a brief struggle, the officers were able to control Johnston and take him into custody.
Although Johnston’s actions and a small black pouch seen attached to his right hip gave Corporal Schmoll the appearance that he had a weapon, when Johnston was searched, it was determined that he did not.
Community Affairs Officer Barbara Stevens of the St. Augustine Police Department reports that Johnston was charged with battery on a law enforcement officer, resisting arrest with violence, and disorderly conduct.
