Local St. Augustine reporters at Historic City News have learned that Saturday night, police were called to 1 Anderson Circle to investigate a report of a woman getting into a vehicle who was said to be carrying an open beer.
Police officers Cory Weber and Bryan Johnson arrived on the scene at about 7:17 p.m. and located
63 year-old Janice Elaine Smith who resides at 425 Katnack Road St Augustine. Smith was sitting in the driver’s seat of her 1991 Infiniti — with the motor running.
According to the police report, Smith had an open 12 oz beer in her lap and a 6 year old boy passenger — who was not wearing a seatbelt in the back seat.
As Smith talked to the officers, they say that they could smell alcohol on her breath.
When she was asked if she had been drinking she advised she had 4 beers.
Smith agreed to perform a series of field sobriety tests. When she was unsuccessful in performing the test she was taken into custody. Smith agreed to a breath alcohol test which confirmed that she was over the legal limit of .08.
Community Affairs Officer Barbara Stevens of the St. Augustine Police Department reports that Smith was charged with DUI and Child neglect. The 6 year old was released to his uncle. The Department of Children and Families was notified of the incident.
