Vote Monday on Aviles Street sidewalk cafes

Ordinance 2009-39, regulating the operation of cafes on a portion of Aviles Street will come on for public hearing and second reading Monday night, as the St. Augustine City Commission holds its first meeting of the new year.

In addition to the usual staff reports and an appointment to replace Miriam Pujals who resigned from the Historic Preservation Advisory Committee, the following proposed ordinances will be read and discussed by the commission, without public hearing;

1. Introduction and consideration of Ordinance 2010-01, temporarily amending Section 4-3 of The City Code regulating the sale, service and consumption of alcoholic beverages.

2. Introduction and consideration of Ordinance 2010-02 creating City Code Section 22-14 and providing for regulation of vending activities and street performer activities in the West Plaza.

3. Introduction and consideration of Ordinance 2010-03,creating Section 22-15 of the City Code and providing for regulation of vending activities and street performer activities in the Ponce de Leon Circle and Anderson Circle.

4. Introduction and consideration of Ordinance 2010-04, amending City Code Section 24-14 prohibiting sales and solicitations in traffic lanes.

5. Introduction and consideration of Ordinance 2010-05, amending Section 8-402 of the City Code to eliminate use criteria as it pertains to floodplain management for existing non-residential structures.

Additionally, Resolution 2010-01, relevant to Economic Stimulus Project Memorandum of Agreement with Florida Department of Transportation will be heard on first reading. A proposed 1,500-foot, 5-foot wide sidewalk will extend from US 1 to San Marco Avenue along the north side of West Castillo Drive. Under the proposed agreement, the Florida Department of Transportation will use economic stimulus funding to design and build the sidewalk and the city will assume its maintenance.
